Plain-Language Summary
In plain English: when you contact us through this website, request service, apply for financing, or sign up for texts or emails, we collect the information you give us and basic information about how you use our site. We use that information to provide service to you, respond to your requests, and improve our website. We do not sell your personal information. We share information only with vendors that help us run our business (for example, our financing partner or a text-message provider) and only as needed to do their job. You can opt out of texts at any time by replying STOP. California residents have specific privacy rights described in Section 14 below.
1. Who This Policy Applies To
This Privacy Policy describes how Precision Heating & Cooling, a California business with its principal address at 1557 Monterey Rd, San Jose, CA 95110, collects, uses, shares, and protects information when you visit our website, contact us by phone, text, or email, or use any service we provide.
By using this website or contacting us, you accept the practices described here. If you do not agree, please do not use the website or submit information through it.
2. Information We Collect
Information you give us directly. When you request service, apply for financing, submit a contact form, request a quote, sign up for texts or emails, leave a review, apply for a job, or otherwise contact us, you may give us your name, phone number, email address, service address, equipment details, photos of the issue, employment history (for careers), and a description of your request.
Information collected automatically. When you visit our website, we and our service providers automatically collect technical data such as your IP address, device and browser type, operating system, referring URL, pages viewed, time spent, and rough geographic location (derived from your IP, not GPS). We use cookies and similar technologies to do this — see our separate Cookie Policy for the details and your choices.
Call recordings and chat transcripts. We may record customer service calls and retain chat or text conversations for training, quality, dispatch, and billing purposes. Where required by law we will announce that calls may be recorded.
Financing applications. If you apply for financing through our partner GoodLeap, you submit information directly to that partner under their privacy practices. We receive only what is needed to confirm financing decisions and schedule your job.
Information from third parties. We may receive information about you from third parties such as referral sources, lead-generation partners, public databases, and review platforms.
3. How We Use Your Information
We use the information we collect to: schedule, dispatch, perform, and bill for HVAC and related services; respond to your inquiries, quotes, and warranty requests; process and follow up on financing applications; communicate with you about your appointment, including by phone, email, and text; send promotional offers and seasonal reminders, where you have consented; improve our website, services, and customer experience; investigate and prevent fraud or misuse; and comply with our legal, tax, and regulatory obligations.
Legal basis. We process your information based on your consent (where required), to perform the service you requested, to comply with the law, and for our legitimate business interests in providing and improving service.
4. How We Share Information
We do not sell your personal information.
We share information with: (a) service providers that help us run our business — for example, our hosting, CRM, dispatch, payment processor (Stripe / GoodLeap (financing)), text-message and email providers, analytics providers, financing partner (GoodLeap), and call-tracking vendors — under contracts that limit their use to performing services for us; (b) professional advisors such as our attorneys, accountants, and insurers; (c) authorities and other parties when required by law, court order, or to enforce our rights, protect safety, or investigate suspected misuse; (d) successors in a merger, acquisition, financing, or sale of all or part of our business; and (e) any other party with your consent.
Aggregated or de-identified information that cannot reasonably be used to identify you may be shared without restriction.
5. Cookies, Analytics & Advertising
We use cookies and similar technologies (web beacons, pixel tags, local storage) to remember your preferences, understand site usage, and measure marketing performance. Our website uses Google Tag Manager and Google Analytics 4 to measure site usage and the performance of our marketing; any other tags are loaded only through that Google Tag Manager container. See our Cookie Policy for the full list and your choices, including the on-site cookie preferences tool.
Global Privacy Control (GPC). We honor opt-out preference signals sent by your browser, including the Global Privacy Control. When we detect a GPC signal from a California resident's browser, we treat it as a request to opt out of any "sale" or "sharing" of personal information (we do not currently sell information, and we limit sharing as described above).
Do Not Track. Some browsers send a "Do Not Track" signal. There is no industry-standard meaning for that signal yet, so we do not separately respond to it — but we do honor GPC as described above.
6. AI & Automated Tools
This website does not currently use AI chat assistants or AI-powered estimators that collect personal information. We may use AI tools internally (for example, to draft educational content) under human review; if we introduce AI-facing features that handle personal information, we will update this Policy and the on-site disclosures before they go live.
7. Data Retention
We retain your information only as long as needed to provide service to you, comply with our legal, tax, accounting, and warranty obligations, resolve disputes, and enforce our agreements. When we no longer need information, we securely delete or anonymize it. Specific retention periods depend on the category of data and the legal hold that applies.
8. Security
We use reasonable administrative, technical, and physical measures designed to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction — including encryption in transit, restricted access on a need-to-know basis, and secured systems. No method of transmission or storage is perfectly secure, however, and we cannot guarantee absolute security.
Payment Security
This website does not collect, process, or store payment card numbers. We never ask you to enter card details on our pages. If you choose to finance a project, you are taken to our financing partner, GoodLeap, whose application and payment pages are hosted by that partner and governed by its own privacy and security practices. Any payment card details you give us in person or by phone are used only to complete your payment through our payment processor and are not saved on this website.
9. Children's Privacy
Our website and services are intended for adults and are not directed to children under the age of 13. We do not knowingly collect personal information from a child under 13. If you believe a child has provided us with personal information, please contact us at info@pheating.com and we will delete it.
10. Third-Party Links
Our website may link to third-party sites (for example, our financing partner's application portal, social media, or review platforms). We are not responsible for the privacy practices of those sites. Please review their privacy policies before submitting information to them.
11. Email Communications
We may send you transactional emails about your service (appointment confirmations, invoices, warranty notices) and, with your consent, promotional emails (seasonal reminders, specials, maintenance plan renewals). Every promotional email contains an unsubscribe link; you may also email info@pheating.com to opt out. We will continue to send transactional emails necessary to complete the service you requested.
12. Text Messages (SMS) — TCPA & A2P 10DLC Consent
When you sign up for text messages from Precision Heating & Cooling, or check a box on a form consenting to text communications, you give your express written consent under the federal Telephone Consumer Protection Act (TCPA) and the carrier A2P 10DLC framework to receive recurring text messages from us at the mobile number you provided, including messages sent using an automatic telephone dialing system or pre-recorded voice.
Message frequency varies based on your interaction with us (for example, appointment confirmations, dispatch updates, billing reminders, and — if you opt in — promotional offers).
Message and data rates may apply. Standard message and data rates from your wireless carrier may apply.
Reply STOP to unsubscribe; reply HELP for help. To stop receiving texts at any time, reply STOP to any message we send. To get help, reply HELP or contact us at (408) 642-8674.
Carriers are not liable for delayed or undelivered messages.
Your consent to receive text messages is NOT a condition of purchase. Mobile phone numbers and the contents of opt-in are NOT shared with third parties for their own marketing.
13. Your Choices
You may: (a) decline to provide information, although that may limit what we can do for you; (b) opt out of marketing emails using the unsubscribe link in any promotional email; (c) opt out of marketing texts by replying STOP; (d) ask us to update or correct your contact information; and (e) ask us to delete information we hold about you, subject to our legal obligations.
To make any of these requests, contact us at info@pheating.com or (408) 642-8674.
14. Your Privacy Choices: California (CCPA / CPRA)
Do Not Sell or Share My Personal Information. We do not sell personal information, and we do not share it for cross-context behavioral advertising. You can still ask us to confirm this or opt out at any time by emailing info@pheating.com or calling (408) 642-8674. You can also turn off optional cookies with the cookie banner, and we treat a Global Privacy Control (GPC) signal from your browser as an opt-out request.
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), gives you the following rights:
(a) Right to know what personal information we collect, the sources, the purposes, and the categories of recipients; (b) Right of access — you may request a copy of the specific pieces of personal information we have collected about you in the prior 12 months; (c) Right to correct inaccurate personal information; (d) Right to delete personal information we collected from you, subject to legal exceptions; (e) Right to opt out of the "sale" or "sharing" of personal information — we do not sell personal information, and we limit sharing as described in Section 4; (f) Right to limit use of sensitive personal information; (g) Right to non-discrimination — we will not deny service, charge a different price, or provide a different level of service because you exercised a privacy right.
How to exercise your rights. Email info@pheating.com or call (408) 642-8674 and tell us which right you are exercising. We will verify your identity (by asking you to confirm information already on file) before processing the request, and we will respond within the time the law requires (generally 45 days, extendable by another 45 days where reasonably necessary).
Authorized agents. You may designate an authorized agent to make a request on your behalf. We will require written proof of the agent's authorization and may require you to verify your identity directly.
Tools in use on this website. The only third-party tools on this website that collect information about your visit are Google Tag Manager and Google Analytics 4 (website analytics). We do not use advertising or retargeting pixels on this website.
Categories of personal information collected. Identifiers (name, address, phone, email, IP address); commercial information (services requested, transaction history); internet or other electronic network activity (browsing on our site); geolocation data (rough, IP-based); audio (call recordings); and professional or employment information (for careers applicants).
Sources. You directly; your device and browser when you visit our website; service providers that help us run our business; public sources; and lead-generation partners.
Purposes. As described in Section 3.
Categories disclosed for a business purpose. We have disclosed identifiers, commercial information, internet/electronic activity, and (where applicable) audio recordings to service providers — under contracts limiting their use — for the business purposes described in Section 4. We do not sell personal information.
Notice of financial incentives. We do not currently offer financial incentives in exchange for personal information.
15. Other States
If your home state has a comprehensive consumer privacy law that grants you specific rights (for example, Virginia, Colorado, Connecticut, Utah, or other states that adopt similar laws), we will honor those rights to the extent the law applies to us and to the personal information at issue. To exercise those rights, contact us using the information in Section 18.
16. Notice of Data Collection at Collection
At or before the time we collect your personal information, this Privacy Policy serves as our notice at collection. We collect the categories listed in Section 14 for the purposes described in Section 3. We retain the categories described in Section 7. We do not sell personal information.
17. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will post the updated Policy on this page and update the "Effective" date below. We encourage you to review this page periodically.
